Gurugram: A complaint has been submitted to the Real Estate Regulatory Authority (RERA), Gurugram, against Bhasin Estate Agency and its representative, Avi Bhasin, alleging violations of the Real Estate (Regulation and Development) Act, 2016.
According to the complaint, the agency, despite holding a valid RERA registration as a real estate agent, is allegedly involved in the marketing, promotion, and facilitation of sales in an unregistered real estate commercial project being developed by the Puri Group on Dwarka Expressway, Sector-111 in Gurugram.
The complainant has alleged that the project is being actively advertised through social media platforms, including Facebook, and has submitted screenshots of promotional posts as evidence before the authority.
Under the provisions of the RERA Act, registered real estate agents are prohibited from facilitating the sale or purchase of units in projects that are required to be registered but do not possess valid RERA registration.
The complaint claims that the agency’s actions amount to a violation of its statutory obligations and the conditions attached to its registration.
Seeking intervention from RERA Gurugram, the complainant has requested a detailed inquiry into the matter and urged the authority to initiate appropriate legal action, including penalties and other measures prescribed under the Real Estate (Regulation and Development) Act, 2016.
When contacted regarding the matter, a representative of Bhasin Estate Agency stated that the advertisement in question had already been deleted. According to the agency, the advertisement was originally posted on 9 July and is no longer active. The representative further clarified that the property is not currently being marketed or offered for sale by the agency through any platform.
The present matter raises questions regarding the role of registered real estate agents in the marketing and promotion of projects that may not possess the mandatory approvals and registrations required under the Real Estate (Regulation and Development) Act, 2016 (RERA).
“Under Section 9 and Section 10 of the RERA Act, registered real estate agents are required to comply with statutory obligations while facilitating the sale, purchase, marketing, or promotion of real estate projects,” a Rera Advocate said.
The law provides that agents must not facilitate transactions in violation of the Act and may face regulatory action for non-compliance. Haryana RERA has the power to suspend or revoke the registration of agents, impose penalties, and take enforcement action where violations are established.
Haryana RERA has repeatedly cautioned homebuyers to deal only with registered agents and has emphasized that brokers, consultants, and intermediaries involved in property transactions are accountable under the Act.
The authority has also stated that misleading advertisements, promotion of projects without requisite approvals, and failure to disclose mandatory RERA details can attract regulatory scrutiny and penalties.
In a recent case, RERA Gurugram initiated proceedings against a developer for allegedly advertising, marketing, and selling a project without obtaining mandatory RERA registration and without disclosing required regulatory details in promotional material.
