Buy property only through registered agents, Gurugram RERA tells homebuyers

Gurugram: The Real Estate Regulatory Authority (RERA), Gurugram, has issued an advisory urging homebuyers to purchase properties only through RERA-registered real estate agents to ensure transparency, legality, and protection of their interests.

The Authority stated that dealing with registered agents helps buyers safeguard their investments and enables them to seek remedies available under the Real Estate (Regulation and Development) Act, 2016, in the event of any future dispute.

In its advisory, RERA emphasized that no real estate agent can facilitate the sale or purchase of property in a real estate project without obtaining registration from the Regulatory Authority as mandated under the Act.

The Authority has also advised prospective buyers to thoroughly review the guidelines and instructions related to real estate agents available on the official RERA Gurugram website before making any investment decision.

Explaining the legal provisions, RERA said that the term “real estate agent” covers any person who negotiates or acts on behalf of another person in transactions involving the sale or purchase of plots, apartments, or buildings in a real estate project. The definition also includes individuals who introduce buyers and sellers for consideration in the form of commission, fees, remuneration, or any other payment.

In practical terms, the category includes property dealers, brokers, consultants, and other intermediaries operating in the real estate market.

The Authority reiterated that any person acting as a real estate agent without obtaining registration from RERA is prohibited from advertising, marketing, facilitating, or undertaking transactions involving properties covered under the Act.

RERA further pointed out that Section 9 of the Real Estate (Regulation and Development) Act, 2016, makes it mandatory for every real estate agent to obtain registration with the concerned Real Estate Regulatory Authority before participating in transactions related to registered real estate projects.

According to the Authority, the provision has been introduced to strengthen transparency, accountability, and consumer protection in the real estate sector. Registration of agents also creates a regulatory framework that allows homebuyers to establish accountability and seek redressal under the Act if grievances arise at a later stage.

The Authority urged buyers to verify the registration status of agents before entering into any property transaction and to remain vigilant while investing in real estate projects.
